Seeking feedback on the recycling cost norms

The Ministry of Natural Resources and Environment is seeking feedback on the draft decision by the Prime Minister, which sets out valid and reasonable recycling cost norms for product and packaging volume, as well as administrative management costs to aid the responsibilities of manufacturers and importers with regards to waste collection and treatment. According to Article 54 of the Environmental Protection Law 2020, individuals and organizations who manufacture and import products and packages with recyclable value must recycle them in accordance with compulsory recycling rates and specifications. They may choose to fulfil their recycling obligations by either creating a product recycling organization for tare or providing financial support to the Vietnam Environmental Protection Fund.

Article 81 of Decree No. 08/2022/ND-CP offers further details on the law, stating that the financial contribution to the Vietnam Environmental Protection Fund for each product and packaging type (F) is calculated using the formula: F = R x V x Fs, in which F represents the total amount that manufacturers and importers must pay to the Vietnam Environmental Protection Fund, R is the mandatory recycling rate of each product and packaging type, V represents the volume of products and packaging produced, marketed and imported in the year that the recycling obligation is implemented, and Fs represents the reasonable and valid cost of recycling for a unit volume of product or packaging, which includes costs of sorting, collection, transportation, product recycling, packaging, and management. The Ministry of Natural Resources and Environment will submit specific Fs for each product and packaging type with an adjustment cycle of three years to the Prime Minister for promulgation in accordance with Clause 2, Article 81 of Decree No. 08/2022/ND-CP.

The draft proposes a valid and reasonable recycling cost of Fs for a unit volume of product and packaging, including recycling costs such as sorting, collection, transportation, product and packaging recycling, and administrative costs. The cost of recycling includes an adjustment factor, which represents the recycling efficiency. Products and packaging with high recycling efficiency have a low coefficient of adjustment, and those with low recycling efficiency have a high coefficient of adjustment.
